Complaint
Both bulletins included reports in connection with Prince Andrew鈥檚 out-of-court settlement with Virginia Giuffre.聽 A viewer complained that archive footage of members of the Royal Family, used to illustrate the stories, had not been labelled as such, and consequently its use had been misleading.聽
Outcome
The ECU considered the complaint in the light of the section of the 麻豆社鈥檚 Editorial Guidelines on accuracy which deals with archive material.聽 This says labelling 鈥渕ay be required鈥, but the test for that requirement is whether the footage in question would materially mislead the audience if not labelled.聽 The ECU thought it entirely apparent from the content of the illustrative footage used in both reports that it was not contemporaneous with the events being reported, and that there was no danger of audiences being led to believe that it was other than archive material.聽 Consequently there was no requirement for it to be labelled.
