Complaint
This bulletin included a report on conditions in one of the London prisons. 聽A warder complained that, although they had asked to be disguised if shown in the item and received assurances from the programme team to that effect (as their manager could confirm), the item included a shot in which they were identifiable.
Outcome
The ECU agreed that the warder was identifiable, although shown only briefly. 聽The ECU accepted that the programme team believed in good faith that they had the warder鈥檚 verbal consent to being both filmed and shown undisguised in the item.聽 However, in the absence of any written or electronic record of the consent process, it could not be shown that the warder had given consent and their complaint was accordingly upheld.
